That guy bought the domain before nissan did. Supposedly nissan took him to court and lost or what not..thats y its nissandriven.com

Quick is right, if it were a win for the little guy he'd be able to use his domain for whatever he pleased (other then something directly competing, or easily comfused with Nissan motors) as it stands now, the domain is worthless too him other then annoying Nissan and perhaps (altho, it would probably void his ruling) selling it to Nissan...

Either way, its not a win...

Now that he beat them in court and cost them millions I think it would be comedy to sell it to them for millions.

He shouldn't have to use a different domain name. His birth name is Nissan and he got the domain and started using it before Nissan motors even know what the Internet was. That ruling is crap.

The thing is, that guy got the domain first, yes. Does he have legitimate interest in it? Maybe... his name is in fact "nissan".

However, I would bet that the VAST majority of hits recieved by that domain name are from people looking for Nissan motors, not Nissan computers. Before that website was shut down, you can bet he was making TONS of advertizing money off that site and all those hits, that he didn't deserve.

Since the guy does seem to have a real interest in the domain name though, I think both sides have a case. Something similar must have happened with Dodge. Until recently, http://www.dodge.com/ had nothing to do with the dodge automotive make, and was owned by someone called "the dodge group", which had nothing to do with cars at all.

He registered domain FIRST and he does have interest in it. His company's name is Nissan Computers. His name is Nissan. What kind of evidence would you like to see in order to convince you that he has legitimate interest?

1. Its nissan's fault for not registering the domain before him (if they were dumb enough not to realize the importance of the internet before, it is THEIR fucking problem, not Mr. Nissan's).

No, Both sides don't have a case.
Nissan Motor Co is trying to makeup for being dumbasses and not registering the domain name first. While Mr. Nissan is defending HIS property.



Lawsuits like this always piss me off. Hell when somebody slams a $10,000,000 lawsuit on your ass (which you have no way of paying, as private individual/small bussiness owner) this is nothing more then a corporate bullying. They are trying to scare you/force you to sell the domain name.

I'm just saying he was offered money for the domain but he declined. maybe he thought if he held out longer he would make more money in the long run. maybe he liked getting those millions of visitors looking for nissan motors. or maybe he just wanted to defend his name and was willing to go through all this trouble and pass by a large sum of money! he didnt care at all about those millions of visitors he could exploit. yea thats it.

i honestly dont think he gives a shit about money. this is jsut another corperation pushing their weight around. he's probably trying to prove a point that hes not gonna take it and that they can go to hell. didnt you read the article?

Hmm .... Lets see:
It is HIS domain name, and he does NOT have to sell it if he does not want to. He BOUGHT the domain name, he OWNS it and therefore he can do whatever the fuck he wants with it.

In addition he has every right to use this domain name. Hell, he was using name Nissan before anybody in the here even heard of Nissan Motor Co.

If the Nissan wants the domain name then they'll have to buy it from him. If he refuses to sell the domain name to them ... well too fucking bad for Nissan.

If I recall something similar happened when Etoys sued Etoy.
